Adressi sananvapauden puolesta

Sananvapautta pidetään maailmanlaajuisesti yhtenä tärkeimmistä kansalaisoikeuksista. Myös Suomen perustuslaissa sananvapaus mainitaan erityisesti. Jotta sananvapaudella olisi mitään arvoa, täytyy sen sisältää myös vapaus keskustella yhteiskunnallisesti hankalista asioista vailla rangaistuksen pelkoa. Myös vallitsevien poliittisten käsitysten kanssa ristiriitaisia ajatuksia on voitava julkaista. Voidaan sanoa, että sananvapaus on demokratian välttämätön edellytys.

Kun sananvapauden kaltainen perusoikeus on muun lainsäädännön kanssa ristiriidassa, on pykälät määriteltävä erityisen tarkasti ja syyttämis- ja tuomiokynnysten on oltava erityisen korkealla. Näin ei tällä hetkellä valitettavasti ole. Viime aikoina Suomessa on ollut useita tapauksia, joissa epäselvien pykälien nojalla on mielivaltaisesti syytetty ja jopa tuomittu useita yhteiskunnalliseen keskusteluun osallistuneita henkilöitä.

Ongelmallisimmat lainkohdat ovat rikoslain 11. luvun 10. § ja 17. luvun 10. §. Edellämainittu on sisällöltään seuraavanlainen:

Rikoslain 11 luvun 10 § (11.4.2008/212)
Kiihottaminen kansanryhmää vastaan

Joka yleisön keskuuteen levittää lausuntoja tai muita tiedonantoja, joissa uhataan, panetellaan tai solvataan jotakin kansallista, etnistä, rodullista tai uskonnollista ryhmää taikka niihin rinnastettavaa muuta kansanryhmää, on tuomittava kiihottamisesta kansanryhmää vastaan sakkoon tai vankeuteen enintään kahdeksi vuodeksi.

Pykälässä mainitut panettelu ja solvaus ovat hyvin epämääräisiä käsitteitä, eikä niitä lakitekstissä tarkemmin määritellä. Käytännössä jää yksittäisen syyttäjäviranomaisen ja tuomioistuimen mielivallan varaan, onko jokin teksti panetteleva tai solvaava. Käytäntö on osoittanut, että tulkinta vaihtelee kyseessä olevan ryhmän mukaan. Tämä johtaa valikoivaan oikeuskäytäntöön, mikä on oikeusvaltiolle täysin sopimaton ajatus.

Uhkaaminen on asia erikseen, eikä sitä pitäisi rinnastaa panetteluun tai solvaukseen.

Toinen ongelmallinen lainkohta kuuluu seuraavasti:

Rikoslain 17 luvun 10 § (24.7.1998/563)
Uskonrauhan rikkominen

Joka

1) julkisesti pilkkaa Jumalaa tai loukkaamistarkoituksessa julkisesti herjaa tai häpäisee sitä, mitä uskonnonvapauslaissa (267/1922) tarkoitettu kirkko tai uskonnollinen yhdyskunta muutoin pitää pyhänä, tai

2) meluamalla, uhkaavalla käyttäytymisellään tai muuten häiritsee jumalanpalvelusta, kirkollista toimitusta, muuta sellaista uskonnonharjoitusta taikka hautaustilaisuutta,

on tuomittava uskonrauhan rikkomisesta sakkoon tai vankeuteen enintään kuudeksi kuukaudeksi.

1. kohta on uskonnonvapautta tunnustavalle yhteiskunnalle hyvin erikoinen. Erilaiset yhteisöt, niin uskonnolliset kuin muutkin, pitävät pyhinä hyvin erilaisia asioita; on outoa, että joidenkin pyhinä pitämät asiat ovat "pyhempiä" kuin toisten. Irvokkaimmillaan tällainen voi johtaa siihen, että vakavia rikoksia tehneen henkilön tekemistä rikoksista ei saa puhua, mikäli kyseinen henkilö on sattunut perustamaan uskonnon. Tämä siis asettaa ihmiset eriarvoiseen asemaan, joka riippuu näiden suhteesta uskontoon.

2. kohta on ymmärrettävämpi. Siinä kuvailtu teko on myös lähempänä varsinaista rikosnimikettä, eikä se yleensä aiheuta sananvapauden kannalta ongelmia.

Molemmat mainitut pykälät ovat ongelmallisia, sillä ne rinnastavat toisiinsa täysin erilaisia tekoja. On oman keskustelunsa paikka, voidaanko pykälien jäljellä olevia osia käsitellä muualla laissa, eli tarvitaanko tiettyjä ryhmiä suojaamaan sen kummempia lakeja kuin ihmisiä ylipäänsä.

Sananvapauden ongelmat eivät myöskään lopu näihin kahteen kohtaan, mutta jostain on aloitettava.

Rikoslain 11. luvun 10. §:stä on poistettava viittaus panetteluun ja solvaukseen, ja 17. luvun 10. §:stä on poistettava 1. kohta.

Uskonrauhan rikkominen

Kiinnitämme tähän asiaan erityistä huomiota tehdessämme äänestyspäätöstä vuonna 2011. Näin toimimme riippumatta siitä, toteuttaako nykyinen eduskunta vaatimustamme vai ei.
